Terms of Service for Mosquito Flamethrower

Agreement to Terms

By downloading, installing, or using Mosquito Flamethrower ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. The App is operated by Bitsy LLC ("we", "us", or "our").

License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use, strictly in accordance with these Terms and any applicable app store terms.

Acceptable Use

You agree not to:

• Modify, reverse engineer, decompile, or disassemble the App
• Remove any copyright, trademark, or proprietary notices
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any portion of the App
• Interfere with or disrupt the App's functionality
• Use automated systems or software to extract data from the App

Intellectual Property

The App, including all content, features, functionality, graphics, design, code, and trademarks, is owned by Bitsy LLC and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not use, copy, reproduce, or distribute any content from the App without our prior written permission.

In-App Purchases and Subscriptions

The App may offer in-app purchases or subscriptions. All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions. We do not store or have access to your payment information. All sales are final and non-refundable except as required by law.

Disclaimer of Warranties

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We make no warranties regarding the accuracy, reliability, or completeness of any content in the App. Your use of the App is at your sole risk.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BITSY LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your access to or use of (or inability to access or use) the App
• Damages resulting from any unauthorized access to or use of our servers
• Damages resulting from any bugs, viruses, or malicious code transmitted through the App
• Damages for personal injury or property damage of any nature

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE APP IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Bitsy LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations

Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the App will immediately cease.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the App after any changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State in which Bitsy LLC is registered, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in that jurisdiction.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
